Sawyer’s Coaching, LLC, d/b/a Heart First provides the “IHPCoaching.com” “www.ihpcoaching.kartra.com” "www.competeheartfirst.com" websites and various related services (together referred to as this “Site”, “Heart First’s Site” or “Heart First’s Website”) subject to your compliance with all the terms, conditions, and notices contained or referenced herein (the “Terms of Use”), as well as any other written agreement between Heart First and you.

In addition, when using particular services or materials on this site, users shall be subject to any posted guidelines or rules applicable to such services or materials that may contain terms and conditions in addition to those in these Terms of Use. All such guidelines or rules are hereby incorporated by reference into these Terms of Use.

1. Terms

By accessing Heart First’s Site, you are agreeing to be bound by these Terms of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this Site. The materials contained in this Site are protected by applicable copyright and trademark law.

2. Use License

Permission is granted to temporarily download one copy of any downloadable materials on Heart First’s Website for personal, non-commercial transitory viewing only.

In no event shall Heart First be liable for any claims or damages (including, without limitation, general damages, compensatory damages, damages for loss of data or profit, or due to business interruption) arising out of the use, or inability to use, the materials on Heart First’s Website, even if Heart First or an authorized agent of Heart First has been notified orally or in writing of the possibility of such damage.

Heart First may revise these Terms of Use for this Site at any time without notice. By using Heart First’s Website, you are agreeing to be bound by the then-current version of these Terms of Use.'

8. Governing Law

Any claim relating to the use of this Site, these Terms of Use, and any and all courses, services, materials, and content provided by Heart First shall be governed by the laws of the state of Washington without regard to its conflict of law provisions.

9. Waiver and Release; Movement and Breathwork

As the user and student utilizing materials provided by, or participating in courses, classes, or workshops (singularly and collectively, “Courses”) with Heart First, I understand that some Heart First Courses include physical movements and exertion. As is the case with any physical activity, the risk of injury, even serious or disabling, is always present and cannot be entirely eliminated.

I understand that it is my responsibility to consult with a physician prior to and regarding my participation in any Heart First Courses, whether in-person or online.

I represent and warrant that I am in good health and physical condition and I have no medical condition which would prevent my full participation, whether in-person or online.

If I am pregnant, become pregnant, or I am post-natal or post-surgical, my agreement to these Terms of Use verifies that I have my physician’s approval to participate.

In consideration of being permitted to participate in Heart First Courses, whether in-person or online, I agree to assume full responsibility for any risks, injuries, or damages, known or unknown, which I might incur as a result of participating in the Courses

In further consideration of being permitted to participate, whether in-person or online, I expressly irrevocably release and waive any and all claims that I have now or may have hereafter for any reason against Heart First, its owners, employees, agents, and independent contractors, for injury or damages that I may sustain as a result of participating in any Courses whether in-person or online.

10. Coaching Disclaimer and Waiver

All coaching services and communication, email, or otherwise, delivered by Heart First, as well as information on Heart First’s Website, are meant to help you identify the areas in your life and in your thinking that may be standing in your way.

However, coaching is not professional mental health care or medical care, and Heart First is not licensed to provide and is not providing professional psychological or psychiatric services.

If you feel psychologically stressed to the point that it is interfering with your ability to function, please have the courage to seek the help you need in the form of a professional counselor.

Coaching may augment your therapy, but the work of coaching is meant to be done when major emotional and psychological wounds are already healing or healed.

By using this site and Heart First services, you acknowledge and agree to these terms.
